Mediation Process

Mediation

In Colorado, mediation is a confidential, party‑driven process, grounded in the Colorado Dispute Resolution Act, where a neutral mediator helps people in conflict talk through issues and reach their own agreements, often before a contested court hearing.

Legal and court context

  • Colorado’s Dispute Resolution Act (C.R.S. § 13 22 301 et seq.) provides the basic legal framework for mediation used in courts and private practice.

  • Many Colorado courts encourage or order mediation, particularly in divorce and parenting cases, before allowing a case to proceed to a contested trial.

  • Agreements reached in mediation can be submitted to the court in writing so a judge can consider adopting them as enforceable court orders.
